Welcome to SoulMate AI. Please read these Terms of Service ("Terms") carefully before using our mobile application ("App"). By accessing or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the App.

2. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Description of Service

SoulMate AI provides an AI-powered companion chat experience. All characters in the App are artificial intelligence entities, not real people. The App uses AI technology to generate responses based on character profiles and conversation context. All AI-generated messages are clearly labeled as such within the App.

Important Disclaimers:

• The AI characters are entirely fictional. They do not have real emotions, consciousness, or the ability to form genuine relationships
• AI-generated content may be inaccurate, inappropriate, biased, or misleading
• AI responses should never be considered professional advice of any kind, including but not limited to: medical, legal, financial, psychological, or therapeutic advice
• If you are experiencing a mental health crisis, please contact your local emergency services or a qualified professional
• We do not guarantee the availability, accuracy, or quality of AI-generated responses
• Your messages are sent to third-party AI providers for response generation. See our Privacy Policy for full details on data processing

4. Account Registration

You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

5. User Conduct

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Send content that is harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Attempt to bypass content filters or safety measures
• Impersonate any person or entity
• Interfere with or disrupt the App or its servers
• Use automated systems or bots to access the App
• Reverse engineer or attempt to extract source code from the App
• Share your account with others or create multiple accounts

6. Content Policy & Reporting

We employ content moderation to maintain a safe environment. We reserve the right to:

• Filter or modify AI-generated content for safety
• Review and remove content that violates these Terms
• Suspend or terminate accounts that repeatedly violate content policies

Reporting Objectionable Content: Users can report inappropriate or harmful AI-generated content by long-pressing any message in the chat and selecting "Report". All reports are reviewed by our moderation team. You may also report content by emailing support@soulmate-ai.com.

Content Filtering: The App employs automated content safety filters that detect and block harmful, abusive, or illegal content in real-time. These filters are continuously updated to maintain a safe environment.

7. Subscription and Payment

Premium Features:

• The App offers optional premium subscriptions with enhanced features, including unlimited messages, exclusive AI characters, priority response times, and access to premium content
• Subscription prices are displayed in the App before purchase and may vary by region
• Prices are in local currency and include applicable taxes

Auto-Renewal:

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your Apple ID or Google Play account will be charged for renewal within 24 hours prior to the end of the current period
• The renewal charge will be at the same price as the original subscription unless we notify you of a price change

Cancellation:

• iOS: Go to Settings > [your name] > Subscriptions > SoulMate AI > Cancel Subscription
• Android: Go to Google Play Store > Menu > Subscriptions > SoulMate AI > Cancel
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial subscription periods
• Deleting the app does NOT cancel your subscription

Free Trials:

• If offered, free trials automatically convert to paid subscriptions at the end of the trial period unless canceled at least 24 hours before the trial ends
• Any unused portion of a free trial will be forfeited when you purchase a subscription

Restore Purchases:

• You may restore previously purchased subscriptions using the "Restore Purchase" feature in the App

8. Intellectual Property

• The App, including its design, features, and content, is owned by SoulMate AI and protected by intellectual property laws
• AI-generated responses are provided for your personal use only
• You retain ownership of the messages you send, but grant us a license to process them for service delivery

9. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim
• We are not responsible for the accuracy, appropriateness, or reliability of AI-generated content

10. Account Termination and Deletion

Account Deletion by You: You may delete your account at any time through:

• The App: Go to Profile > Delete Account or Settings > Delete Account
• The Web: Visit our Account Deletion page

Upon deletion, all your personal data, conversations, and custom characters will be permanently removed within 30 days. See our Privacy Policy for full details.

Termination by Us: We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the App ceases immediately, and we may delete your data in accordance with our Privacy Policy.

11. End User License Agreement (EULA)

This section serves as the End User License Agreement for the SoulMate AI application.

• License Grant: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device that you own or control, solely for your personal, non-commercial use
• License Restrictions: You may not: (a) copy, modify, or distribute the App; (b) sublicense, lease, or rent the App to any third party; (c) reverse engineer, decompile, or disassemble the App; (d) remove or alter any proprietary notices or labels on the App
• Apple Users: For users who downloaded the App from the Apple App Store, this EULA is between you and SoulMate AI (not Apple). Apple has no obligation to furnish maintenance or support services for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the App. Apple is a third-party beneficiary of this EULA and may enforce it against you
• Termination: This license is effective until terminated. Your rights under this license will terminate automatically if you fail to comply with any of its terms

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the modified Terms.

13. Dispute Resolution

Any dispute arising from or relating to these Terms or your use of the App shall be resolved as follows:

• Informal Resolution: Before filing any formal claim, you agree to first contact us at support@soulmate-ai.com and attempt to resolve the dispute informally for at least 30 days
• Governing Law: These Terms shall be governed by and construed in accordance with the laws applicable in your jurisdiction of residence, without regard to conflict of law principles
• Jurisdiction: Any legal proceedings shall be conducted in the courts of competent jurisdiction in your area of residence, unless otherwise required by applicable consumer protection laws
